1. General

1.1 These general terms and conditions apply to all offers and agreements of Connected Mind OÜ, registered in Estonia (reg. no. 17448555), Tornimäe tn 5, 10145 Tallinn, Estonia. Email: info@nellbauduin.com — Website: www.nellbauduin.com

1.2 By placing an order or entering into an agreement, you confirm that you agree to these terms and conditions. Connected Mind OÜ reserves the right to amend these terms after the expiry of the current term.

1.3 Unless otherwise agreed in writing, general or specific terms or conditions of third parties are not accepted by Connected Mind OÜ.

1.4 Connected Mind OÜ guarantees that the delivered product or service meets the agreement and complies with the specifications stated in the offer.

1.5 You have entered into an agreement with Connected Mind OÜ for the provision of coaching services, training advice, and guidance of (online) programs. For all matters relating to coaching, you should contact Connected Mind OÜ directly.

2. Delivery

2.1 Delivery takes place while stocks last.

2.2 In the context of distance selling rules, Connected Mind OÜ will execute orders within at least 30 days. If this is not possible, the client will be notified within one month and has the right to cancel the order free of charge.

2.3 All timeframes stated on the website are indicative and no rights can be derived from them.

3. Prices

3.1 Prices will not be increased during the term of the offer, unless legal measures make this necessary or if the supplier implements interim price increases.

3.2 All prices on the website are subject to typographical errors. No liability is accepted for the consequences of such errors.

3.3 All prices on the website are in EUR and exclusive of VAT unless stated otherwise.

3.4 You acknowledge that this agreement is non-transferable. The price for coaching is agreed upon in advance. You acknowledge that advance payment is required. Payments made are non-refundable, unless the conditions stated under ‘Refund Guarantee’ are met. Connected Mind OÜ has the right to terminate the program at any time without refund if you fail to follow the program or behave inappropriately.

3.5 Any outstanding payment that is not settled by the due date will be automatically increased by a fixed compensation of 10% of the outstanding amount, with a minimum of €75.00, without prior notice, and without prejudice to court and enforcement costs. In addition, default interest will be owed in accordance with the applicable legal interest rate.

4. Right of Withdrawal

4.1 The right of withdrawal does not apply to:

— Services that have commenced with the client’s consent before the 14-day period.

— Goods or services whose price is subject to fluctuations in the financial market.

— Goods manufactured to the client’s specifications or with a clearly personal character.

— Goods or services that cannot be returned by their nature (e.g. hygiene or perishable goods).

— Audio and video recordings and computer software where the client has broken the seal.

— E-learning programs (online courses) and training programs.

 

4.2 For digital products such as an application, a right of withdrawal of 14 calendar days applies from the date of purchase, provided the client has not yet started using the product.

5. Subscriptions and Payments

5.1 The client commits to the full duration of the program as stated on www.nellbauduin.com at the time of enrollment. Early termination is not possible.

5.2 After the minimum period, subscriptions (where applicable) are cancellable on a monthly basis with one month’s notice.

5.3 Connected Mind OÜ reserves the right to amend subscription terms, including prices, after the expiry of the current term. Existing clients will be informed in a timely manner.

6. Data Management

6.1 When you place an order with Connected Mind OÜ, your data will be stored in our client database. We comply with applicable data protection legislation (GDPR) and will not share your data with third parties without your consent. See our Privacy Policy at www.nellbauduin.com.

6.2 Connected Mind OÜ respects the privacy of website users and ensures confidential handling of your personal data.

6.3 You must report any medical contraindications to Connected Mind OÜ during the program. You must not be under the influence of drugs, alcohol or medication during coaching sessions.

6.4 For the execution of the agreement, Connected Mind OÜ requires the following data: name, address, phone number, email address and billing details. This data will not be used for other purposes.

7. Guarantee

7.1 Connected Mind OÜ guarantees that its products and services meet reasonable requirements of usability, reliability and quality.

7.2 Connected Mind OÜ is not responsible for the ultimate suitability of the services for each individual application, nor for any advice regarding their use.

7.3 Complaints must be reported in writing via info@nellbauduin.com within 14 calendar days of delivery. Connected Mind OÜ aims to handle complaints within 14 business days.

8. Offers

8.1 Offers are without obligation unless otherwise stated.

8.2 Verbal commitments are only binding once expressly confirmed in writing.

8.3 Supplements, changes and/or additional agreements are only valid if agreed in writing.

9. Agreement

9.1 An agreement between Connected Mind OÜ and a client is established after an order or assignment has been assessed for feasibility.

9.2 Connected Mind OÜ reserves the right to refuse orders or assignments without stating reasons, or to accept them only under the condition of advance payment.

10. Force Majeure

10.1 Connected Mind OÜ is not liable if and to the extent that its obligations cannot be fulfilled due to force majeure.

10.2 Force majeure includes: delays by suppliers, internet outages, power failures, email disruptions, transport difficulties, strikes, government measures, illness of staff, and disruptions in technology provided by third parties.

10.3 In the event of force majeure, Connected Mind OÜ reserves the right to suspend its obligations or to dissolve the agreement in whole or in part. No penalty or compensation will be owed in such cases.

11. Liability

11.1 You acknowledge that you have enrolled in a program involving intensive physical and/or mental activities, including coaching, meditations and personal development trajectories. You confirm that you are in good physical and mental health and do not suffer from any condition that could limit your participation.

11.2 By participating, you release Connected Mind OÜ from all claims arising from your participation in the program. You understand that you may experience physical or mental discomfort and release Connected Mind OÜ from any liability, now or in the future, including but not limited to medical costs, lost income, or pain and suffering.

11.3 Connected Mind OÜ is not liable for indirect damages, consequential damages or loss of profit. Coaching and guidance are supportive in nature and do not replace medical, legal or financial advice.

12. Intellectual Property

12.1 All documents, content, methods and materials provided by Connected Mind OÜ are protected by copyright and remain the property of Connected Mind OÜ. They may not be used, copied or reproduced without prior written consent.

12.2 Any intellectual property created within the contractual relationship remains with Connected Mind OÜ unless otherwise agreed in writing.

13. Governing Law and Jurisdiction

13.1 All agreements are governed by the laws of Estonia.

13.2 Any disputes that cannot be resolved amicably will be submitted to the competent court of the place of residence of the representative of Connected Mind OÜ.

13.3 All complaints regarding delivered services or products must be submitted in writing via email to info@nellbauduin.com within 14 calendar days.

14. Refund Guarantee

Do you follow my proven step-by-step plan and achieve absolutely zero results within the agreed period? Although highly unlikely, in that case I will refund you 100%. If I cannot help you, I do not want to earn from it. It is that simple.

You must be able to demonstrate with evidence that you have fully followed and applied my step-by-step plan and learning materials. That goes without saying.
